Terms of Use
The terms that apply when you use Seva.
Last Updated: November 6, 2026
1. About These Terms
These Terms of Use (the “Terms”) govern your access to and use of the mobile application and related services provided by Seva Intelligence Inc. (the “Company,” “we,” “us” or “our”), including its AI-powered care coordination platform (the “Platform” and, collectively, the “Services”).
The Services help individuals, families, caregivers and, where applicable, clinicians and other care organizations organize, understand and coordinate information relating to autism, ADHD and related care.
The Services are an information management and care coordination tool. The Company does not provide medical or other healthcare services through the Services and does not independently diagnose conditions, conduct clinical assessments, recommend treatment or therapy, or make clinical decisions on behalf of users or healthcare providers.
By selecting “I agree” or otherwise expressly accepting these Terms through the Services, you agree to be bound by them. If you do not agree, you must not create an account or use the Services.
Our Privacy Policy, available at Privacy Policy, describes how we handle personal information. Acceptance of these Terms does not replace any separate privacy consent required by applicable law.
During the current pilot, the Services are provided directly to families. Healthcare professionals may participate through invitations to a child’s Care Circle. Their participation does not, by itself, establish an affiliation, partnership or services agreement between the Company and those professionals or their organizations.
Community and care organizations may help families access the pilot. Their involvement does not give them access to a family’s account or information. Access must be separately authorized through the available sharing controls and permitted by applicable law.
If the Company introduces Services under agreements with healthcare providers or other organizations, separate terms may apply to those arrangements.
2. Eligibility and Ontario Pilot
You must be at least 18 years old and have the legal capacity to enter into these Terms to create an account or participate as an invited user.
When the Services are provided directly to individuals, an account for managing a child’s care may be created only by:
(a) the child’s parent or legal guardian; or
(b) another caregiver authorized by the child’s parent or legal guardian to create and manage the child’s profile and provide the child’s information.
In each case, the account holder must have the lawful authority and any consent required to create and manage the profile and provide information through the Services.
The Services currently support profiles for children under 18. Individuals under 18 may not create their own accounts or access the Platform independently. The Platform does not currently permit an adult to create an account for themselves as the person receiving care.
Ontario residence and access location
During the Ontario pilot, individual account holders must maintain their primary residence in Ontario. Receiving care in Ontario does not, by itself, satisfy this requirement. You must provide accurate eligibility information and promptly notify us if your primary residence changes.
Active features are also restricted to use from within Ontario, including where an Ontario resident is temporarily travelling outside the province. We use IP-based approximate location information and connection checks to help administer these restrictions, as described in the Privacy Policy. Location and VPN checks occur after you sign in and during your use of the Platform.
Where your connection appears to originate outside Ontario, we may place your access in a restricted mode that permits viewing existing information and downloading supported items but disables active features, including adding or editing information, generating new AI outputs, inviting participants and sharing information through the Platform. Continued viewing and downloading remain subject to lawful authority and any required consent. These checks are not always accurate. If you believe a restriction was applied incorrectly, contact support@myseva.ai for review.
Where we detect a VPN connection, all access to the Platform, including viewing and downloading, is blocked until the VPN is no longer detected and the applicable access requirements can be verified.
Active access may be restored once we reasonably verify that you meet the applicable residence and location requirements. We may request information reasonably necessary to review a restriction. Proof of Ontario residence does not, by itself, establish that you are physically accessing the Services from Ontario.
Age Limits and Profile Information
You must provide the child's accurate date of birth. Corrections to a date of birth must be requested through support@myseva.ai and may require reasonable verification. You must not change profile information to circumvent an eligibility restriction.
Based on the date of birth recorded in the child's profile, we will send the account holder responsible for the profile reminders 60 days, 30 days and 1 day before the child's eighteenth birthday concerning the resulting changes to profile access. When the child turns 18, active features for that profile will be disabled.
Existing caregiver and Care Circle access to that profile, including viewing, downloading, sharing and deletion controls, will also be restricted pending verification of the individual’s consent or another lawful basis for continued access. These restrictions do not automatically delete the records or affect access to other eligible children’s profiles.
Being the account holder or the individual’s parent does not, by itself, establish continuing authority over the adult’s information. The individual or a legally authorized representative may contact support@myseva.ai to request access to or handling of existing records. We may reasonably verify identity, consent and representative authority before restoring or granting access. Any permitted access will be limited to the affected individual’s information and will not transfer another user’s account or provide access to other individuals’ profiles.
Access to existing records does not activate an adult care profile or restore active care-coordination features. The Platform does not currently support those features for adults receiving care. Subscription consequences are addressed in Section 13.
Changes in Authority
You must promptly notify us if you no longer have authority to manage a profile or if your authority becomes subject to a dispute, court order or other legal restriction. We may restrict access and profile controls while we review the information reasonably necessary to establish authority, as described in Section 4.
Restrictions do not automatically delete your account or information. Information retrieval, deletion and retention remain subject to Sections 18 and 19, the Privacy Policy and applicable law. Applicable cancellation and refund rights remain unaffected.
3. Accounts and Security
You must provide accurate, current and complete account information and keep it up to date. You must not impersonate another person or misrepresent your identity, residence, age, professional status or authority.
You must protect your account credentials and access links, use the security features made available to you, and promptly notify us at support@myseva.ai if you suspect unauthorized access or a security incident.
You are responsible for your use of the Services and use you authorize through your account. You must not permit another person to use your credentials. Invited users must access the Services through their own authorized access.
You are not responsible solely because unauthorized activity occurred through your account. Responsibility for that activity will depend on the circumstances and applicable law.
4. Authority to Provide Information and Manage Profiles
You may provide, access, connect or share information concerning another person only where you have lawful authority to do so.
You represent that you have obtained any consent required by applicable law for the collection, use and disclosure of information you provide through the Services, including information retrieved from connected sources.
Being a parent, guardian or caregiver does not necessarily authorize every collection, use or disclosure of a child’s information. Where applicable law requires consent from a child or youth who is capable of providing that consent, you must obtain it.
You must promptly update or stop using the relevant permissions if your authority changes, consent is withdrawn, or a court order or other legal restriction affects your access or sharing rights.
If we receive credible information that your authority has ended, is disputed or is legally restricted, we may suspend access to the affected profile, including viewing, sharing, downloading and deletion, while the matter is reviewed. We may request information reasonably necessary to verify authority and preserve relevant information pending resolution. Access may be restored, modified or transferred where appropriately authorized and permitted by law. We do not determine custody, guardianship or other legal disputes.
5. Care Circles and Invited Users
Where available, authorized account holders may invite family members, caregivers, health care professionals and other individuals to a “Care Circle” to access specified information or assist with coordinating a child’s care through the Services. Each participant’s access is subject to their assigned permissions, lawful authority and any required consent.
You must invite only persons authorized to receive the information you make available to them and grant permissions appropriate to their role and lawful authority.
Invited users must create their own accounts, complete the required onboarding, accept these Terms and expressly accept the invitation before accessing a Care Circle. They must acknowledge the Privacy Policy and provide any separately required consent. They may access, use and share information only within their granted permissions and as permitted by applicable law.
An account holder with the required lawful authority may modify or revoke an invited user’s permissions or remove them from the Care Circle through the available controls. Revocation or removal ends access through those permissions but does not retrieve information previously downloaded, copied or shared outside the Services.
Healthcare professionals and other regulated users remain responsible for their professional obligations, including confidentiality, consent, recordkeeping and clinical judgment. Participation in a Care Circle does not, by itself, establish a professional relationship or an obligation to monitor or respond to information entered into the Services.
6. Licence and Acceptable Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable and non-sublicensable licence to access and use the Services for their intended purposes while you remain authorized to do so.
You must not:
(a) use the Services in violation of applicable law, a court order or another person’s rights;
(b) provide or access information without the required authority or consent;
(c) misrepresent your identity, professional status or authority;
(d) upload malicious code or interfere with the operation, availability or security of the Services;
(e) attempt to access accounts, information or systems without authorization;
(f) reverse engineer, decompile, disassemble or attempt to derive source code, except where permitted by applicable law;
(g) use automated means to scrape, extract or access the Services without our written permission, except through functionality we expressly provide;
(h) infringe intellectual property, confidentiality or privacy rights;
(i) use the Services to harass, threaten, exploit or otherwise harm another person; or
(j) sell, sublicense or commercially exploit access to the Services without our written permission.
7. User Content
“User Content” means information and materials you submit, upload, connect or otherwise make available through the Services, including documents, health and care information, notes, messages and prompts.
As between you and the Company, you retain any ownership rights you have in your User Content. These Terms do not transfer ownership of another person’s information to you or give you rights you do not otherwise hold.
You grant the Company a non-exclusive, royalty-free licence to host, reproduce, process, organize, format, display and transmit User Content only as reasonably necessary to:
(a) provide and maintain the Services and functionality you request;
(b) carry out sharing you authorize;
(c) protect, support and troubleshoot the Services; and
(d) comply with applicable law and enforce these Terms.
We may permit service providers to carry out those activities on our behalf, subject to the Privacy Policy, applicable agreements and law.
This licence does not independently authorize the use of personal information for AI model training or other secondary purposes. Those uses are governed by the Privacy Policy and any consent required by law.
The licence continues only for as long as reasonably necessary for the permitted purposes, including any lawful retention described in the Privacy Policy.
You must take reasonable care to ensure that information you provide is accurate and identify material errors when you become aware of them. We do not independently verify all User Content.
We may restrict or remove content where reasonably necessary to address a breach of these Terms, unlawful activity, a security risk or a legal requirement.
8. AI Features and Medication Information
Certain features use artificial intelligence, including technology provided by third-party large language model providers. Information submitted to an AI-enabled feature and, where necessary, relevant information available through the Platform may be processed to generate the requested output, as described in the Privacy Policy.
AI features may summarize or organize information, locate information in records, assist with preparing questions and care briefs, identify patterns in recorded information, facilitate communication, and provide general informational and care coordination support.
Certain features may provide personalized insights and informational estimates based on information you voluntarily enter or upload, including patterns or trends in sleep, mood, behaviour, food, medication adherence or menstrual cycles. These features help users organize and understand recorded information. They do not constitute medical advice, diagnosis, clinical assessment, treatment recommendations, therapy or clinical monitoring.
AI outputs may contain errors, omissions, outdated information or statements that appear reliable but are incorrect. Different requests may produce different results. You must review outputs for accuracy and suitability before relying on or sharing them.
Clinical information displayed or summarized through the Services may originate from users or uploaded records. Its appearance in an output does not mean the Company generated, independently verified or endorsed it.
When a medication is added to a child’s profile, the Services automatically initiate a check for potential interactions or contraindications involving other medications recorded in that profile. The check may use an external search provider. Search queries may include medication names and, where relevant, a diagnosis or health condition, as described in the Privacy Policy and applicable consent notices. Where a potential concern is identified, the Services may display an informational alert with links or citations to relevant sources.
These checks and alerts are informational and do not constitute a clinical assessment. Results may be delayed, incomplete, inaccurate or inapplicable to the individual. The Services may miss an interaction or contraindication or identify one that does not apply. An alert does not establish that a medication combination is unsafe, and the absence of an alert does not establish that it is safe.
Do not start, stop or change medication, treatment or therapy based solely on the Services. Confirm relevant information with a qualified healthcare professional or pharmacist. Do not disregard professional advice or delay seeking it because of information provided through the Services.
Healthcare professionals remain responsible for independently assessing information and exercising professional judgment.
9. No Emergency Service or Clinical Monitoring
The Services are not an emergency service and must not be used to seek urgent medical assistance. If you believe there is a medical emergency or an immediate risk of harm, call 911 or seek appropriate emergency assistance.
The Services do not provide continuous clinical monitoring, assess immediate safety, or guarantee that a concerning symptom, medication issue or other risk will be identified.
Entering information or sending a message does not guarantee that a clinician, caregiver or Company representative will review it, receive an alert or respond within any particular time.
The Services may provide medication, appointment, task and activity reminders, together with Care Circle and access-related notifications. Medication reminders may include a notification when a scheduled intake has not been logged. An absent entry does not establish that a dose was missed, and a recorded entry does not independently verify that medication was taken. Users may disable medication reminders through the available settings.
Reminders, notifications and messages may be delayed or fail. You should maintain appropriate arrangements for important appointments, medications and care responsibilities rather than relying exclusively on the Services.
10. Privacy and Consent
Our Privacy Policy describes the collection, use, disclosure, protection, retention and deletion of personal information.
Where required, we obtain separate consent through onboarding or feature-specific notices. These Terms and the User Content licence do not override applicable privacy rights or expand the purposes described in those notices and the Privacy Policy.
The Company does not currently use personal information submitted through the Platform to train, fine-tune or otherwise improve its own AI models. Its third-party AI/LLM providers are not permitted to use information submitted through the Platform to train or improve their own AI models.
Any proposed future use of personal information for AI model training or another materially different purpose will be addressed through appropriate notice and consent where required by applicable law, as described in the Privacy Policy.
The location of processing and storage, including circumstances in which information may be processed outside Canada, is described in the Privacy Policy.
Requests concerning access, correction, deletion or withdrawal of consent may be submitted through the available controls or to the Privacy Officer identified in the Privacy Policy. Withdrawal of consent may affect our ability to provide particular features or Services, as explained in the Privacy Policy.
Where information is held on behalf of a healthcare provider or organization, applicable requests may need to be addressed through that provider or organization.
11. Connected Services and External Links
You may choose to connect supported third-party services, such as Google Drive, Gmail or calendar services. You must have authority to establish the connection and grant the requested permissions.
Your use of those third-party services remains subject to their applicable terms. We do not control their availability or changes to their functionality.
Disconnecting a service removes the applicable authentication credentials and prevents further access through the connection. It does not automatically remove information previously retrieved and incorporated into your chat history or used by other Platform features. That information is handled under the Privacy Policy.
External websites and search sources are provided for convenience and information. A link or citation does not constitute an endorsement or assurance of accuracy.
Service providers engaged by the Company to operate the Services are addressed in the Privacy Policy.
12. Availability, Updates and Pilot Features
We may update or modify the Services to improve functionality, maintain security, comply with law or respond to operational requirements.
The Services may experience interruptions, delays, errors or loss of functionality. Pilot and beta features may be incomplete and may change during development.
Where practicable, we will give reasonable advance notice of a material reduction in functionality or planned discontinuation. Immediate changes may be necessary for security, legal or technical reasons.
For planned discontinuation, we will provide reasonable advance notice and an opportunity to download supported items you are authorized to access, where reasonably practicable. The Services currently support downloads of certain individual reports and uploaded documents; they do not provide a complete account export in a single file. You may contact support@myseva.ai about other information-access requests, which will be handled in accordance with the Privacy Policy and applicable law.
Any changes affecting paid Services remain subject to the applicable purchase terms and your rights under law.
13. Fees and Subscriptions
Some Services may be offered without charge. Paid features will be identified before purchase.
After the pilot, eligible new users may receive a one-week introductory trial. During that trial, Pro features will be enabled. The trial’s duration, included features and eligibility conditions will be disclosed before it begins. Unless you separately choose and authorize a paid subscription, you will not be charged when the trial ends, and access will be limited to the free Basic tier.
Purchases and Renewal
Before you purchase a paid feature or subscription, the applicable purchase process will disclose the price, currency, taxes or other charges, billing frequency, subscription period, renewal arrangements, cancellation procedure and any trial or refund terms.
A subscription will renew automatically only where that arrangement has been disclosed and you have agreed to it.
Paid subscriptions are purchased through the Apple App Store or Google Play and processed through the relevant app store’s in-app purchase system. The Company does not directly collect or store payment card or other payment credentials. We may receive transaction identifiers, purchase confirmations and subscription information necessary to verify purchases and administer subscriptions.
We will disclose changes to recurring charges in advance and obtain consent where required. You may cancel renewal before an increased charge takes effect.
We will not charge for a previously free feature without first disclosing the applicable charges and obtaining your agreement.
Cancellation and Subscription Management
For app-store subscriptions, use the applicable app-store controls to manage or cancel renewal. Deleting the app or your account may not cancel an app-store subscription.
Cancelling renewal, downgrading a subscription and the effective date of any change are governed by the terms disclosed at purchase and the applicable app-store procedures, subject to mandatory rights under law. Except where we expressly undertake below to prevent renewal, a restriction on Platform access does not itself cancel an app-store subscription. Subscription-management assistance remains available through support@myseva.
Cancelling renewal does not, by itself, end access before the conclusion of the paid subscription period, subject to the applicable purchase terms and law. Access remains subject to the eligibility, restriction and termination provisions of these Terms.
A cancelled or expired subscription will not be reactivated or renewed without your authorization.
Refunds and Billing Errors
Except where applicable purchase terms, app-store policies, the provisions below or applicable law provide otherwise, subscription fees are non-refundable, and we do not provide partial or prorated refunds for unused subscription periods.
Please report suspected billing errors promptly, preferably within 30 days of the charge. This requested reporting period does not shorten any period or remove any right available under applicable law or app-store policies.
Refunds for app-store purchases are administered through the relevant platform's procedures, as further described below, without limiting the Company's obligations under these Terms or applicable law. Contact support@myseva.ai if you require assistance.
Incorrect Access Restrictions
If we confirm that an incorrectly applied eligibility or location restriction prevented access to paid features, we will assist you in obtaining a prorated refund or an extension equal to the verified period of lost access, subject to the applicable app-store procedures and any rights under applicable law.
For Google Play purchases, you may choose between a prorated refund and an extension, where supported by Google Play. For Apple App Store purchases, refund requests and subscription extensions are subject to Apple's applicable procedures and approval.
Any prorated refund will be calculated by multiplying the actual subscription fee paid for the affected billing period by the number of verified days of lost access, divided by the total number of days in that billing period.
We will not provide both an extension and a refund for the same period. Any refund or extension will be administered in accordance with the applicable app-store procedures, without limiting any rights or remedies available under applicable law.
Correctly Applied Access Restrictions
A correctly applied temporary eligibility or location restriction does not automatically entitle you to a refund for the current paid period, subject to the provisions below, applicable law and app-store policies. You may cancel renewal at any time through the applicable app-store controls.
If you again meet the applicable eligibility and location requirements, access may resume for any remaining paid period. If your subscription has expired or been cancelled, you may choose to resubscribe once eligibility has been verified.
If an annual subscriber is unable to access paid features for more than 30 consecutive days because they are outside Ontario or no longer have an eligible child under 18 covered by their subscription, the subscriber will be eligible for a prorated refund of unused prepaid subscription time for qualifying Google Play purchases, subject to the applicable provisions below. Refund requests for Apple App Store purchases are subject to Apple's applicable refund procedures.
For qualifying Google Play subscriptions, the prorated refund will be calculated from the date access to paid features stopped through the end of the prepaid annual subscription period. The refund will equal the actual annual subscription fee paid, multiplied by the number of unused prepaid days and divided by the total number of days in the paid annual subscription period.
No refund is payable under this provision if access to paid features is restored within 30 consecutive days.
App Store Refunds and Extensions
Google Play Purchases
For subscriptions purchased through Google Play, we will process qualifying prorated refunds within 15 days after the subscriber becomes eligible for the refund, using Google Play's available refund procedures.
If a prorated refund cannot be processed through the usual procedure, we will use an available alternative method, including a full refund where necessary and permitted by Google Play.
Where a restriction is temporary, a subscriber may elect to request a deferral of the next billing date or an extension of the prepaid subscription period instead of a refund, subject to Google Play's applicable procedures.
Apple App Store Purchases
For subscriptions purchased through the Apple App Store, refund requests must be submitted to Apple through its applicable refund procedures. Apple determines whether a refund will be granted and the amount of any refund, which may not be prorated.
We will provide reasonable assistance with refund requests, including providing supporting purchase information to Apple where appropriate and with any required consent.
Where a restriction is temporary and Apple declines a refund, we may seek an extension of the subscription period to compensate for the period of restricted access, subject to Apple's applicable procedures. An extension cannot be guaranteed.
Before purchasing an annual subscription through the Apple App Store, subscribers will be informed that Apple determines refund requests and that prorated refunds may not be available.
Nothing in this subsection limits any refund, cancellation or other consumer rights available under applicable law.
Renewal During Access Restrictions
If an eligibility or location restriction remains unresolved as the next renewal approaches, we will prevent the next renewal charge through the applicable app-store process. We will notify you of the action taken and any steps you must complete.
Preventing renewal does not, by itself, create an entitlement to a refund for the current paid period. Refunds and extensions remain subject to the provisions above, applicable app-store procedures and applicable law.
When a Child Turns 18
We will provide advance notice of the changes to profile access when a child turns 18, as described in Section 2.
If the subscription covers only the affected child, or no other eligible children remain covered, we will prevent future renewal when active features stop. If other eligible children remain covered, the subscription will continue unless cancelled.
Where an annual subscription has unused prepaid time remaining and no eligible children remain covered, the applicable refund and subscription extension provisions of this Section will apply.
For Apple App Store purchases, we will not offer an annual subscription if all children covered by the subscription will turn 18 before the end of the proposed annual subscription period. Where an annual subscription is unavailable for this reason, monthly subscription options may be offered instead.
Restrictions do not automatically delete the affected profile's records. Continued viewing, downloading, sharing or deletion remains subject to the authority and consent requirements in Sections 2 and 4 and the Privacy Policy.
Other Service Interruptions
Requests relating to significant service interruptions not addressed above will be assessed in light of the circumstances, applicable purchase terms, app-store policies and applicable law.
14. Intellectual Property
The Company and its licensors own the Services and their software, interfaces, designs, branding and other proprietary materials, excluding User Content and third-party materials.
Except for the licence expressly granted by these Terms, no intellectual property rights are transferred to you.
You must not use Company trademarks, logos or branding without written permission, except as permitted by law.
We do not promise that AI outputs are unique, eligible for intellectual property protection or free from third-party rights. These Terms do not give you exclusive rights in outputs or prevent similar outputs from being generated for others.
15. Disclaimers
To the extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis, without warranties or conditions concerning uninterrupted availability, freedom from errors, completeness, accuracy or suitability for a particular purpose.
To that extent, we disclaim implied warranties and conditions of merchantable quality, fitness for a particular purpose and non-infringement.
We use safeguards appropriate to the information we handle, as described in the Privacy Policy, but cannot guarantee absolute security.
Nothing in these Terms excludes a warranty, condition, duty or remedy that cannot lawfully be excluded, or relieves the Company of obligations imposed by applicable privacy or consumer protection law.
16. Limitation of Liability
Subject to the exceptions below and to the extent permitted by applicable law, the Company will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from the Services or these Terms.
Subject to the same exceptions, the Company’s total aggregate liability arising from the Services or these Terms will not exceed the greater of:
(a) the fees paid by you for the Services during the 12 months preceding the event giving rise to the claim; and
(b) $500 Canadian.
These exclusions and limitations do not apply to:
(a) the Company’s fraud, wilful misconduct or gross negligence;
(b) death or personal injury caused by the Company’s negligence; or
(c) liability, rights or remedies that cannot be excluded or limited under applicable law.
These provisions do not restrict your right to make a complaint to a privacy regulator or other competent authority.
17. Responsibility for Third-Party Claims
To the extent permitted by law, you agree to indemnify the Company and its directors, officers and employees against reasonable losses, liabilities and legal expenses resulting from a third-party claim arising from:
(a) your material breach of these Terms;
(b) your unlawful use of the Services; or
(c) content you knowingly provide without the required rights, authority or consent.
This obligation applies only to the extent the claim results from your conduct. It does not apply to losses attributable to the Company’s breach of these Terms, negligence or other wrongful conduct.
We will promptly notify you of a claim for which we seek indemnification and provide reasonable cooperation. You may assume its defence using competent counsel reasonably acceptable to us, and we may participate at our own expense.
Neither party may settle a claim in a manner that imposes an admission, payment or other obligation on the other party without that party’s consent, which must not be unreasonably withheld.
18. Suspension and Termination
We may suspend or terminate access where reasonably necessary because:
(a) you materially breach these Terms;
(b) you no longer satisfy eligibility requirements or have the required authority;
(c) use of the account creates a material security or safety risk; or
(d) suspension or termination is required by law.
Where reasonably practicable, we will notify you of the reason and give you an opportunity to address the issue. We may act immediately where notice or continued access could create a risk or conflict with law.
You may stop using the Services at any time and request account deletion through the available controls or by contacting us. Subscription cancellation is addressed in Section 13.
Following restriction or termination, any continued viewing, downloading or other access is subject to your lawful authority, applicable consent, security requirements and the Privacy Policy. Where direct access is unavailable, you may contact support@myseva.ai to request assistance retrieving information you are entitled to receive. Restriction or termination does not automatically eliminate applicable cancellation or refund rights.
19. Account Deletion and Retention
You may request deletion of your account through the available controls or by contacting us. Deletion of information concerning another person remains subject to your lawful authority, any required consent, applicable law and the restrictions described in Sections 2 and 4. Once account deletion is completed, the user’s account records and chat history are permanently deleted from the primary active systems, except for information that must be retained under applicable law or is reasonably necessary for an ongoing complaint, investigation or dispute. Any retained information is restricted to those purposes and deleted when no longer required. The account cannot be recovered.
A profile restricted because the individual has turned 18 will remain frozen for 12 months after their eighteenth birthday. During that period, the individual or a legally authorized representative may request existing records through our support process, subject to Sections 2 and 4 and the Privacy Policy. Requesting or receiving records does not activate an adult care profile.
At the end of that period, we will delete the affected profile and associated personal information from our primary active systems, unless earlier deletion has been lawfully requested and completed. We may preserve information where required by applicable law, necessary to complete an outstanding access or correction request, or reasonably necessary for an ongoing complaint, investigation or dispute. Any preserved information is restricted to those purposes and deleted when no longer required. Residual copies in AI-monitoring systems and backups are handled as described below. Deletion of the affected profile does not, by itself, delete the account holder’s account or other individuals’ profiles.
A profile restricted while authority is being reviewed has not been deleted. Requests concerning that profile remain subject to Sections 2 and 4 and the Privacy Policy.
Certain information may remain temporarily in AI-monitoring systems and encrypted routine backups. Information maintained in those systems is automatically deleted or overwritten within 30 days and is not used for ordinary business purposes. Login logs and location/network security events are handled in accordance with the Privacy Policy. If a backup is restored, applicable deletion requests will be reapplied.
We may retain a limited, non-identifying record of the deletion where reasonably necessary to document and verify the deletion, maintain security, comply with applicable legal or regulatory requirements, or respond to an active complaint, investigation or dispute. That record does not contain health information and cannot reasonably be linked to the deleted user.
Deleting an account does not delete copies previously downloaded or independently retained by other authorized users, clinicians or organizations.
Where we process personal health information on behalf of a healthcare provider or organization, retention and deletion are governed by that organization’s instructions, our agreement with it and applicable law. At the end of the applicable engagement, information will be returned or deleted in accordance with those requirements.
20. Changes to These Terms
We may amend these Terms to reflect changes to the Services, legal requirements or our operations.
For a material amendment, we will provide advance notice through email or the Services, explain when it takes effect and obtain renewed acceptance where required by law or appropriate to the nature of the change.
Changes will apply prospectively and will not remove rights arising before their effective date.
If you do not accept a material amendment, you may stop using the Services and cancel any renewal. Existing paid commitments and cancellation or refund rights remain subject to applicable law and the terms accepted when purchased.
Urgent changes necessary to address a legal or security requirement may take effect sooner, with notice as soon as reasonably practicable.
21. Governing Law and Disputes
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, subject to any mandatory law that applies to you.
Subject to rights concerning jurisdiction and venue under applicable law, you and the Company submit to the jurisdiction of the courts of Ontario for disputes arising from these Terms or the Services.
You may contact us to seek an informal resolution. Doing so is voluntary and is not a condition of commencing a legal proceeding or making a regulatory complaint.
After a dispute arises, you and the Company may separately agree in writing to mediation or arbitration.
Nothing in these Terms requires arbitration, waives participation in a class proceeding, or limits access to courts or remedies where that right is protected by law.
22. General Provisions
Severability. If a provision is invalid or unenforceable, it will be severed to the extent necessary, and the remaining provisions will continue to apply.
Waiver. A failure or delay to enforce a provision does not waive the right to enforce it later.
Assignment. You may not transfer your account or contractual rights without our written consent, except as permitted by law. We may assign these Terms in connection with a merger, reorganization or transfer of the relevant business, provided the successor assumes our obligations. Any transfer of personal information remains subject to applicable privacy law and the Privacy Policy.
Entire Agreement and Priority. These Terms and any applicable purchase terms constitute the agreement governing your use of the Services. Any separate agreement expressly governing Services provided through a healthcare provider or other organization applies according to its terms. Purchase terms govern the specific pricing, billing and subscription matters they address, subject to mandatory rights under law. If there is an inconsistency concerning the handling of personal information, the Privacy Policy governs that issue, subject to applicable law and any separate agreement governing information processed on behalf of a healthcare provider or organization. No provision authorizes the collection, use or disclosure of personal information contrary to applicable law or required consent.
Survival. Provisions concerning accrued payment obligations, intellectual property, liability, third-party claims, disputes and lawful retention survive termination to the extent necessary to give them effect.
23. Additional App Store Terms
If you obtain the app through the Apple App Store:
(a) these Terms are between you and the Company, not Apple. The Company is responsible for the app and its content;
(b) your licence permits use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including applicable Family Sharing or volume-purchasing arrangements;
(c) the Company is responsible for applicable maintenance and support. Apple has no obligation to provide maintenance or support;
(d) the Company is responsible for applicable warranties to the extent they have not been lawfully disclaimed.
